John Ritchie Sr. Estate, Buchanan Co., Missouri

To all whom these presents shall come.
William H. Ritchie Administrator of the estate of John Ritchie deceased sends greeting:
Whereas at the February Term 1848 of the County Court of Buchanan County in the State of Missouri, the following order was made by said Court, to wit: Now at this day comes William Ritchie administrator of the estate of John Ritchie deceased, and applies for an order to sell the real estate of said deceased, and the court being satisfied that notice of this application has been given according to the order of this court heretofore made, and nothing to the contrary being shown, it is ordered by the court here that said William Ritchie administrator as aforesaid be and he is hereby authorzed to sell according to law the whole or so much of said real estate as shall be sufficient to pay the debts of said deceased and publication of the notice of such sale in a newspaper is hereby dispensed with and whereas after the making of said order, Isaac Norman, Peter C. Templeton and John Powel, three disinterested householders of said county viewed and appraised at my instance, the east half of the Northwest quarter of Section no. 9 in Township no. 55 and of Range 34 containing 80 acres, situated in said county, and belonging to said state, and delivered to me, the said administrator, the following certificate thereof, under their hands, to wit:
"We the undersigned, being called on by William H. Ritchie administrator of the estate of John Ritchie deceased to appraise the east half of the north west quarter of section no. 9 in township no. 55 and of range 34 containing 80 acres, and after reviewing the same we appraise it to the sum of three hundred dollars.  Subscribed and sworn to before me the undersigned Justice of the Peace, this the ninth day of February 1848.  Hiraim ? Cox."

And whereas copied of the following notes to wit:
"Public Sale.  The undersigned administrator of the estate of John Ritchie deceased will offer at public sale, at the court house door in the town of Saint Joseph on Monday the 27th day of March rent? the east half of the north west quarter of section no. 9 in township no. 55, and of range 34, containing 80 acres.  There are on the premises a good dwelling house, stables and other improvements.  Terms cash in hand (signed) William H. Ritchie, administrator, February 8, 1848"

were put up in the public places in said county, twenty days before said sale.  And whereas I, the said administrator, in accordance with said notice, offered the said land, at public sale, at the court house door, in the town of St. Joseph, on the 27th day of March 1848, while the circuit court of said county was in session, and Richard V. Brinton being the highest and best bidder for the same, it was ???ed off to him, at the price of two hundred and sixteen dollars.  And whereas at the June Term 1848 of the said county court being the rent? term of said county court after said sole, the same having failed to sit in April or May, I the said administrator returned into the said county court in regard to the sale aforesaid, the following report of my proceedings, to wit:
"In the Buchanan County Court, June Term 1848.  To the County Court William H. Ritchie, administrator of the estate of John Ritchie deceased respectfully returns into court here the following report of his proceedings, under an order of this court heretofore made, authorizing him as such administrator to sell all the interest of the deceased in the east half of the north west quarter of section no. 9 in township no. 55 and of range no. 34, containing 80 acres.  After having caused notices, containing a particular description of the estate to be sold and stating the time, place and terms of sale, to be put up in the public places in the county aforesaid, whereas said land is situated, 20 days before the sale (a copy of which said notice together with the certificate of appraisment of said land is herewith filed, and made a part of this report) the undersigned in accordance with said notice offered the said land at public sale, at the court house door in the town of St. Joseph on the 27th day of March 1848, while the circuit court of said county was in session and Richard Brinton being the highest and best bidder for the same it was ?moched off to him at the price of two hundred and sixteen dollars, which he is ready to pay whenever this report is approved by the court and a deed duly acknowledged and delivered all of which is respectfully submitted (signed) William H. Ritchie administrator"

to which said report was attached the following affidavit to wit:
"The said William H. Ritchie on his oath says that the foregoing report is true in substance and in fact, and that he did not directly or indirectly purchase such real estate, or any part thereof, or any interest therein, and that he is not interested in the property sold, except so stated in said report (signed) William H. Ritchie.  Subscribed and sworn to before me this first day of May 1848 (signed) William Fowler, clerk"

and whereas the said report has been approved by the said county court and the said Richard Brinton has this day paid to me the said administrator the said sum of two hundred and sixteen dollars, the receipt whereof is thereby acknowledged.  I the said William H. Ritchie as administrator as aforesaid by virtue of the foregoing proceedings and in consideration of the purchase money aforesaid, to me paid as aforesaid, have granted ha???? and sold, and by these presents do grant bargain and sell unto the said Richard V. Brinton all the right title and interest which the said John Ritchie deceased had in and to the tract of land so foresaid.  Witness my hand and seal, June the 5th, 1848. signed William H. Ritchie (seal)

County of Buchanan ss.  Be it remembered that on this fifth day of June in the year of our Lord one thousand eight hundred and forty eight before me the undersigned Clerk of the Circuit Court within and for the county aforesaid personally approved William H. Ritchie who is personally known to me to be the person whose name is subscribed to the annes?? deed as having executed the same as party thereto and acknowledged the same to be his act and deed for the purposes therein mentioned.  In testimony whereof I set my hand and affix my private seal (there being no official seal provided) at office this the day and year last aforesaid.
